  1. Processing Personal Data when Using Website and Online Platforms Categories of Processed Personal Data, Purpose of Processing and Legal Entitlement

    If you visit the Diamant Unipool website or online tools (collectively referred to as “website”), Diamant Unipool may process the following personal data:

    • personal data which you actively and voluntarily provide via the website (e.g. when filling out the Tentative Costing form, Contact Us form, Carrier, Request for Maintenance/Warranty Claim Report, Pool (De)winterisation, or if you contact us with your inquiries) containing your name, e-mail address, address, telephone number and other information submitted as part of a request for details, costing, support
    • data automatically sent to us through your browser or devices, such as IP address, device type, browser type, referring website, websites visited during your visit to our website, and the date of every website request

    Diamant Unipool processes your personal data for the following purposes:

    • providing website services
    • creating a commercial offer
    • responding to your specific requirements
    • marketing messaging, with your permission, e.g. on more relevant content, offers and latest news about our products and promotions which may interest you
    • to the extent strictly necessary, complying with applicable conditions of use, maintaining Diamant Unipool’s legal claims or their protection
  2. Processing Personal Data while Being in Business with Diamant Unipool Categories of Processed Personal Data, Purpose of Processing and Legal Entitlement

    In connection to the business relationship between you and Diamant Unipool, Diamant Unipool may process the following categories of personal data of existing and future contact persons of our customers, suppliers, resellers and partners (collectively referred to as “business partners”):

    • contact details, e.g. first and last name, business address, business telephone number, fax and e-mail
    • payment details, e.g. data necessary to carry out payments and to prevent fraud, as well as other relevant billing information
    • other information vitally processed within a project or contractual relationship with Diamant Unipool or voluntarily provided by the business partner, e.g. personal data related to a concluded offer, transferred payments and requirements
    • personal data collected from publicly available sources, from rating and credit agencies
    • if required by law for screening the business partners: date of birth, ID numbers, personal documents, information on significant and relevant court proceedings and disputes with the given business partner

    Diamant Unipool processes your personal data for the following purposes:

    • communication with business partners about Diamant Unipool’s or the business partners’ products and services, e.g. answers to inquiries and requests or providing details on purchased products
    • planning, performance and management of contractual relationships with business partners, e.g. executing transactions and orders of products or services, processing payments, book-keeping, securing shipments and deliveries and providing services
    • maintaining and protecting safety of our products
    • ensuring compliance with legal obligations, export inspection and customs matters
    • resolving disputes, enforcing contractual agreements and exercising or protecting legal claims

    Processing of your personal data is necessary for the fulfilment of the above objectives. Unless provided otherwise upon collecting your personal data, the legal basis for the processing of personal data is:

    • your explicit consent to processing personal data (Article 6, Section 1(a) of the General Data Protection Regulation)
    • processing is necessary for the fulfilment of contractual relationship with you (Article 6, Section 1(b) of the General Data Protection Regulation)
    • processing is otherwise required for efficient performance and management of mutual business relationship (Article 6, Section 1(f) of the General Data Protection Regulation)
  3. Transfer and Disclosure of Personal Data

    Diamant Unipool is entitled to transfer personal data to other Diamant Unipool companies and third parties, but only in such cases and to such extent necessary for the above purposes. The service providers of Diamant Unipool (“processors”), e.g. hosting and IT management, act only on the basis of the Diamant Unipool’s instructions and are contractually bound to act in accordance with applicable legal regulations on personal data protection.

    In these cases, Diamant Unipool takes all necessary measures to ensure adequate and appropriate safeguards on personal data protection using relevant resources.

  4. Retention Period

    Unless explicitly stated otherwise upon collecting your personal data, such data will be deleted, provided their retention is not necessary in connection to purposes for which they were collected or otherwise processed or to the compliance with legal obligations on retention arising from applicable legal regulations (e.g. tax and business law).

  5. Consent Withdrawal

    If you have given your consent with processing some of your personal data to Diamant Unipool, you are entitled to withdraw this consent at any time with future effect, i.e. withdrawing your consent will not affect the legality of processing which took place prior to the withdrawal of your previously given consent. The consent withdrawal does not affect the processing of personal data which the controller processes based on other legal entitlement than your given consent.

  6. Right of Access, Correction and Deletion of Personal Data, Restricting Processing

    According to the applicable legal regulations on personal data protection, you have certain rights regarding your personal data:

    • to ask Diamant Unipool whether the personal data are being processed and, if so, you have the right of access to such data
    • to correct inaccurate data concerning your person which are processed by Diamant Unipool
    • to delete or anonymise personal data collected by Diamant Unipool
    • to restrict the processing of your personal data by Diamant Unipool
